Terms of Service

Effective July 26, 2026 · As A Service Enterprises (“Fenster,” “we,” “us”).

By using Fenster, you agree to these terms. If you do not agree, please do not use the service.

1. What Fenster is — and is not

Fenster is an information and coordination tool. It gathers public-records and listing data, estimates value from comparable properties, computes typical transaction timelines, and lets you talk it through with AI specialists. Fenster is not a real-estate brokerage, lender, appraiser, title company, law firm, or fiduciary, and using it does not create any agency, fiduciary, or attorney–client relationship.

2. Fair Housing

Fenster reports facts and does not rate, rank, or steer you toward or away from neighborhoods, in keeping with the Fair Housing Act. You agree not to use Fenster to discriminate against any person on the basis of race, color, religion, sex, familial status, national origin, disability, or any other protected class.

3. AI limitations

The AI specialists can be inaccurate, incomplete, or out of date, and may occasionally produce errors. Treat their output as a starting point, not a final answer, and verify anything you rely on. Fenster does not guarantee the accuracy of AI responses or of third-party data.

4. Accounts

Some features require an account (handled by our authentication provider). You are responsible for activity under your account and for keeping your credentials secure. You must be at least 18.

5. Acceptable use

• Don’t use Fenster for any unlawful purpose or to violate anyone’s rights.
• Don’t scrape, overload, reverse-engineer, or attempt to bypass security or rate limits.
• Don’t upload other people’s personal information unless you have the authority to do so.
• If you connect an MLS, your use of that data is also governed by your agreement with your MLS or data provider. You represent that you are licensed and permitted to access it.

6. Third-party data

Property records, listings, flood, demographic, and school data come from third-party sources (including government records and MLS feeds). We present them with their provenance but do not guarantee their accuracy, completeness, or timeliness.

7. Your content

You keep ownership of the content you enter (deals, notes, messages). You grant us the limited rights needed to store and process it to operate the service for you, as described in our Privacy Policy.

8. Disclaimer of warranties

Fenster is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any data or estimate is accurate.

9. Limitation of liability

To the fullest extent permitted by law, As A Service Enterprises will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, data, or goodwill, arising from your use of Fenster. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the twelve months before the claim, or US$100.

10. Indemnification

You agree to indemnify and hold As A Service Enterprises harmless from claims arising out of your use of the service, your content, or your violation of these terms.

11. Changes & termination

We may update these terms; material changes update the effective date. We may suspend or end access for violations of these terms. You may stop using Fenster at any time and request deletion of your data.

12. Governing law

These terms are governed by the laws of the State of Maryland, without regard to conflict-of-laws rules.
